During the year ended December 31, 2009, the Mexican operations represented approximately 21% of the Company�� net sales. CEMEX Mexico is a direct subsidiary of CEMEX and is both a holding company for some of the operating companies in Mexico and an operating company involved in the manufacturing and ma! rketing of cement, plaster, gypsum, groundstone and other construction materials and cement by-products in Mexico. Until recently, I would have avoided regional banks. However, the green shoots of the U.S. recovery are now sturdy enough that select financial institutions are showing highly bullish charts backed by strong fundamentals. Both the technicals and fundamentals tell me there is a good trading opportunity at hand.

According to the Federal Deposit Insurance Corp. (FDIC), the number of bank failures has dropped dramatically since June 2011. At this time two years ago, 48 banks had entered receivership. By this time in 2012, the number dropped to 31. So far this year, only 16 banks have failed -- one-third the number of failures compared with 2011.

 

Moreover, revenue and earnings prospects for select regional banks should continue to improve. For starters, the Federal Reserve's pledge to keep interest rates near record lows means low-cost loans for consumers, and that translates to strong loan demand at banks. Burger King Worldwide, Inc., incorporated on April 2, 2012, is a fast food hamburger restaurant, under the Burger King brand. As of December 31, 2012, the Company had 2,989 franchise restaurants and 132 Company restaurants in EMEA. While in Germany continues with 684 restaurants as of December 31, 2012, Turkey and Russia are two of its growing markets with net openings of 78 restaurants and 47 restaurants, respectively, during the year ended December 31, 2012.

Latin America and the Caribbean (LAC)

As of December 31, 2012, the Company had 1,290 franchise and 100 Company restaurants in LAC. In 2011, the Company entered into a joint venture agreement with Vinci Partners for Brazil and granted franchise and development rights to the joint venture. The Company received a minority stake and board seats in the joint venture without deploying its own capital.

Asia Pacific (APAC)

As of December 31, 2012, the Company had 1,007 franchise and 3 Company restaurants in APAC. As of December 31, 2012,the Company had 357 restaurants in Australia. It's just not true, and Burger King (BKW) proved that in its latest quarter. McDonald's longtime nemesis posted better than expected profitability during the first three months of the year, fueled by marginally positive comparable-restaurant sales for the period. It may not seem like much of a victory. Burger King's worldwide comps rose 2 percent, with its U.S. and Canada locations clocking in with a meager 0.1 percent increase. However, even that baby step up is better than the 1.7 percent decline at McDonald's. Unlike Ronald McDonald, Burger King isn't clowning around. The Whopper Beats the Big Mac? This would be an opportune time for Burger King to break away from the larger chain that it's been copying for years. We've seen Burger King offer up items that are blatantly similar to McCafe smoothies, Chicken McBites, Big Macs, Egg McMuffins, and even the cult fave McRibs. However, now that McDonald's is in a rut -- having posted three consecutive quarters of negative comparable-restaurant sales in this country -- it appears Burger King is ready to carve its own path. Drybulk Operations

The Company manages the deployment of its drybulk fleet between long-term and short-term time charters. A time charter is a contract to charter a vessel for a fixed period of time at a specified or floating daily or index-based daily rate and can last from a few days to several years. A spot charter refers to a voyage charter or a trip charter or a short-term time charter. Under a bareboat charter, the vessel is chartered for a stipulated period of time, which gives the charterer possession and control of the vessel, including the right to appoint the master and the crew.

Offshore Drilling Operations

In January 2012, following the completion of the contract with Tullow Oil plc (Tullow Oil) contract, discussed below, the Eirik Raude commenced a contract with Anadarko Cote d��voire Company (Anadarko) for the drilling of two wells offshore West ! Africa. I! ts offshore drilling operations consist of the Ocean Rig Corcovado, the Ocean Rig Olympia, the Ocean Rig Poseidon and the Ocean Rig Mykonos. As of December 31, 2011, the Ocean Rig Corcovado was employed under a three-year contract, plus a mobilization period, with Petroleo Brasileiro S.A. (Petrobras Brazil) for drilling operations offshore Brazil. The Ocean Rig Olympia is operating under contracts to drill a total of five wells for exploration drilling offshore Ghana and the Ivory Coast. The Ocean Rig Poseidon commenced a contract with Petrobras Tanzania, a company related to Petrobras Oil & Gas B.V. (Petrobras Oil & Gas).

The Ocean Rig Mykonos commenced a three-year contract, plus a mobilization period, with Petrobras Brazil, on September 30, 2011, for drilling operations offshore Brazil. DryShips�� wholly owned subsidiary, Ocean Rig AS, provides supervisory management services, including onshore management, to its operating drilling rigs and drillships. DryShips also has contracts to provide offshore drilling services and drilling units.

Tanker Operations

The Company employs its Aframax tankers Saga, Daytona, Belmar and Calida, in the Sigma tanker pool, which consists of 46 Aframax tankers, with fourteen different pool partners. During 2011, refined petroleum products transported include the various blends of finished gasoline, gasoline blendstocks, jet fuel, No. 2 oil, naphtha, heating oil and diesel fuel, and represented 16% of the segment�� revenues. The Company also classifies ethanol in the refined petroleum product category. Customers are oil and refining companies, marketers and ethanol producers.

The marine transportation inland operation moves and handles a range of cargoes. As of December 21, 2011, of the 819 inland tank barges operated, 618 were petrochemical and refined products barges, 123 were black oil barges, 63 were pressure barges, 10 were refrigerated anhydrous ammonia barges and five were specialty barges. Marine transportation services for inland movements are conducted under long-term contracts, ranging from one to five years. Kirby Inland Marine, LP (Kirby Inland Marine) operates commercial tank barge fleeting service (temporary barge storage facilities) in ports, including Houston, Corpus Christi and Freeport, Texas, Baton Rouge and New Orleans, Louisiana and other locations on the Mississippi River. The Hawaii Division services local petroleum retailers and oil companies distributing refined petroleum products and black oil products between the Hawaiian islands and provides other services to the local maritime community. As of December 31, 2011, the Hawaii Division�� fleet consisted of tank barges in the 52,000 to 86,000 barrel capacity range and tugboats in the 1200 to 7200 horsepower range, transporting refined petroleum products for local and regional customers, black oil products to power generation customers, and the delivery of bunker fuel to ships. The Hawaii Division also provides service docking, standby tug assistance and line handling to vessels using the Single Point Mooring installation at Barbers Point, Oahu, a facility for tankers to load and discharge their cargos through an offshore buoy and submerged pipeline without entering the port. As of December 31, 2011, the coastal fleet consisted of 59 tank barges, 56 of which were double hull and three of which were single hull, with 3.8 million barrels of capacity, transporting refined petroleum products and black oil products. As of December 31, 2011, the Company operated 65 Company-owned coastal tugboats ranging from 1000 to 11800 horsepower. BOSTON -- Cybersecurity company FireEye has acquired Mandiant, the computer forensics specialist best known for unveiling a secretive Chinese military unit believed to be behind a series of hacking attacks on U.S. companies. FirEye (FEYE) shares jumped more than 20 percent after Thursday's announcement of the $1.05 billion cash-and-stock deal, which FireEye said closed Monday. It unites two companies with relatively new technologies for thwarting cyber attacks, and brings together two of the most-respected executives in the security industry: FireEye CEO Dave DeWalt and Mandiant founder Kevin Mandia. While sales of older anti-virus products have been on the decline, security experts expect strong growth in both FireEye's cloud-based systems for detecting malicious software and Mandiant's software that analyzes cyber attacks. About a year ago the two companies entered into a technology development agreement that made it easier to deploy their products together. With the merger, FireEye will gain Mandiant's team of forensics investigators. "They have these very strong Navy 'cyber' Seals who respond to breaches and are very good at what they do," DeWalt said about Mandiant. He had previously served as chairman of Mandiant's board. "My aim is to create the strongest security company in the world," DeWalt said in an interview. FireEye, which has yet to post a profit, said the acquisition will be immediately accretive to earnings and expects the combined company's revenue to grow about 50 percent this year. In comparison, Symantec (SYMC), the biggest maker of anti-virus software, has said it expects fiscal 2014 revenue to drop 3 percent to 4 percent. Mandiant is best known for its forensics services.
